Agreement to Terms

These Terms of Use ("Terms") constitute a legal agreement between you and Accessibility Technologies, a product of Kosansh Solutions Inc. ("we," "us," or "our"), governing your access to and use of our website, products, and services that we are building and will deliver.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services. These Terms apply to all users, including visitors, customers, and authorized users of our products and services.

Accessibility Technologies is developing a platform of accessibility products and services, including:

  • Sign Language Assist: Interpreter scheduling and sign language services (in development)

  • Mobility HMI Pack: Accessible interfaces for autonomous vehicles (in development)
  • User Testing Panel: Outcome-based accessibility testing services (in development)
  • Professional Services: Audits, remediation, training, and consulting (in development)

All content, features, and functionality of our services are owned by Accessibility Technologies, Kosansh Solutions Inc., or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

Our Rights: You acknowledge that our services, including software, designs, text, graphics, logos, and other materials, are proprietary and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our express written permission.

Your Content: You retain ownership of content you submit through our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing and improving our services.

Feedback: Any feedback, suggestions, or ideas you provide regarding our services may be used by us without obligation or compensation to you.

Service Availability and Modifications

We are building our products and services with the goal of providing reliable, high-quality accessibility solutions. However:

  • We do not guarantee uninterrupted or error-free service availability
  • We may perform maintenance, updates, or modifications that temporarily affect service availability
  • Service features, capabilities, and interfaces are subject to change as we develop and improve our platform
  • We reserve the right to modify, suspend, or discontinue features with reasonable notice
  • Beta and preview features may be unstable and are provided "as-is" without warranties

We will make reasonable efforts to provide advance notice of planned maintenance or significant changes that may affect service availability.

Payment Terms

For paid services and subscriptions:

  • Billing: Fees are billed in advance according to your selected plan. Payment is due upon invoice date.
  • Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds: Refund policies vary by service and will be specified in your service agreement. Generally, fees are non-refundable except as required by law.
  • Price Changes: We reserve the right to modify pricing with 30 days' notice to existing customers.
  • Taxes: You are responsible for any applicable taxes, duties, or fees.

Disclaimers and Limitations of Liability

Our services are provided "as-is" and "as-available" without warranties of any kind, either express or implied.

Service Disclaimers: We disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that services will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, completeness, or reliability of service outputs
  • Warranties that services will meet your specific requirements or expectations

Limitation of Liability: To the maximum extent permitted by law, our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Accessibility Technologies, Kosansh Solutions Inc., and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit through our services

Termination

Either party may terminate these Terms at any time:

  • By You: You may stop using our services and close your account at any time.
  • By Us: We may suspend or terminate your access immediately if you violate these Terms, with or without notice.
  • Effect of Termination: Upon termination, your right to use our services ceases immediately. We may delete your account data in accordance with our Privacy Policy.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from or related to these Terms or our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation is unsuccessful
  • Binding arbitration in accordance with the rules of the American Arbitration Association, if mediation is unsuccessful
  • Courts of Tarrant County, State of Texas, United States, for matters not subject to arbitration

You waive any right to participate in class action lawsuits or class-wide arbitrations.

AI-Generated Content and Services

Our platform utilizes artificial intelligence (AI) and machine learning technologies extensively to generate content, images, and deliver services.

AI-Generated Content: We use AI tools to generate website content, images, reports, and other materials. This includes:

  • Website content and copy generated using AI writing tools
  • Images generated using AI image generation services (including 1min.ai and other providers)
  • Accessibility reports and analysis generated through AI-powered scanning and analysis
  • Captions, translations, and other service outputs generated using AI models

Content Sources and Attribution: Where applicable, we attribute content sources, research data, and industry statistics. Market data, research findings, and industry benchmarks are sourced from publicly available reports, government publications, and industry research organizations including:

  • World Health Organization (WHO) Global Report on Assistive Technology
  • ADA Title II Web Accessibility Rule documentation
  • UsableNet Accessibility Lawsuit Tracker
  • Market Research Future and other industry research firms
  • Government accessibility standards and regulatory guidance

AI Limitations and Disclaimers:

  • AI-generated content may contain inaccuracies, errors, or outdated information
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • AI-generated images and content are provided for illustrative and informational purposes
  • Users should verify critical information independently and not rely solely on AI-generated content
  • We reserve the right to modify, correct, or remove AI-generated content at any time

Intellectual Property: AI-generated content, including images and text, may be subject to the terms and conditions of the AI service providers we use. We make reasonable efforts to use AI services that provide appropriate licensing for commercial use, but we can't guarantee that all AI-generated content is free from third-party intellectual property claims.

No Warranty: AI-generated content is provided "as-is" without warranties of any kind. We disclaim all liability for errors, omissions, or inaccuracies in AI-generated content. Users assume all risk associated with the use of AI-generated materials.

General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
